I’ve heard from clients that creditors have lied to them, telling them that they can no longer file for bankruptcy because of the new law. That is usually not the case.
Your income is a significant factor in whether or not you can file for bankruptcy. The new law has a means test. New Jersey has one of highest median incomes in the nation. If you are below that income, you are usually eligible for Chapter 7. If you are above that income, Chapter 13 may work for you.
The next major change in the new law is the requirement for credit counseling and financial education. This is not complicated, and I can help you get the counseling you need. I have always been a big advocate of financial education for my clients. That’s why I wrote a book on the subject.
